It is common now for the very wealthy to enter into marriages with a prenuptial agreement in order to protect the party who is extremely wealthy from being bilked by a would-be gold digger. Given the fact that everyone knows how vicious and extremely expensive divorce can be, prenuptial agreements would appear to be a very rational arrangement.
Today we have the so-called “Me Too Movement” where women who have been victimized by some kind of sexual transgression are coming forward and identifying the man who victimized them. This is all to the good versus what happened in the old days where the victimized woman would just stay mum for a variety of questionable reasons — she felt she wouldn’t be believed, she didn’t want the blowback, she didn’t want the embarrassment of being victimized, she didn’t want the ordeal of a trial, etc.
But has the pendulum swung too far in the opposite direction when even an esteemed Supreme Court nominee gets hit with character assassination along these same lines? The estimates for the number of fraudulent claims brought by women ranges from 2 to 8% for those cases that are proceeded with, but 45% of the cases are not proceeded with but dropped, so the number of fraudulent claims could be much higher — no one really knows. And we are dealing here with interpersonal relations where the woman may in fact be very motivated to maliciously smear the man who, for whatever reason, she wants to injure.
So where does this leave the young man who wants to initiate a sexual relationship with a woman but is now afraid of a potential lawsuit by his would-be lover. Instead of the two of them being carried away under the moonlight with strains from a Cole Porter song in their hearts, would he in particular be well advised to seek out a presexual agreement before things gets hot and heavy. Not exactly a most romantic gesture on his part, but has it come to this? How else could he prove that it was consensual?
